Do I need a
certificate of inheritance?

Often not. When the death certificate is enough and when a certificate of inheritance (Erbschein) becomes necessary.

For cancellations the death certificate is usually enough

To cancel contracts such as phone, electricity, subscriptions or memberships, a copy of the death certificate is enough in most cases. Some providers also ask about your relationship to the deceased or for a power of attorney.

When a certificate of inheritance may be needed

A certificate of inheritance proves who the heirs are. It is mainly needed when it comes to the assets themselves, for example:

  • to access bank accounts if there is no power of attorney valid beyond death
  • to transfer a property in the land register
  • for some insurance policies or securities accounts

If there is a notarised will with the probate court's opening record, that is often accepted instead.

Where to apply

You apply at the probate court, the local court (Amtsgericht) at the deceased person's last place of residence, or through a notary. The fees depend on the value of the estate, and it often takes a few weeks. So only apply when you really need it.

How we can help

You do not need a certificate of inheritance for the cancellation service. The death certificate is usually enough. Where a power of attorney is needed, we prepare it for you.

This guide gives a general overview of the situation in Germany and is not legal advice. For individual cases, the probate court, a notary or a lawyer can help.
